In this Decision of the Ontario Divisional Court, the Court addressed an application for judicial review brought by Gate Gourmet (the “Employer”) in response to an Award of Arbitrator Morton Mitchnick.

In the Award, Arbitrator Mitchnick found that Gate Gourmet violated the collective agreement by transferring a backlog of work from its location at Toronto’s Pearson International Airport to its location at Ottawa’s Macdonald–Cartier International Airport.

The Employer argued in its application for judicial review that the Award was unreasonable and that it should be overturned.

Justices Sachs, Backhouse and Kurke of the Divisional Court unanimously agreed with the Union’s position that the Award was reasonable and dismissed the Employer’s application for judicial review.
