In this Ontario Labour Relations Board decision of January 24, 2020, Vice-Chair Waddingham found that a blanket claim of solicitor-client privilege could not be used to deny the Union access to a third party consultant’s report.
The ruling states that “the report was not commissioned or created for the purpose of seeking or providing legal advice” and accordingly, “is not protected by the solicitor-client privilege covering communications between WORLDPAC and its counsel.”
